TERMS OF SERVICE

Version: 2.0
Effective date: 21 August 2026
Contact: tazz@katzapparel.co.nz

OVERVIEW

Welcome to KATZ Apparel & Print.

The terms “KATZ”, “we”, “us” and “our” refer to KATZ Apparel & Print.

KATZ Apparel & Print operates this online store and website, including the information, content, features, tools, products and services made available through it, collectively referred to in these Terms as the “Services.”

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service, together with our Privacy Policy, Returns & Cancellation Policy, Shipping Policy and any other policies referenced on our website, explain the rights and responsibilities that apply when you access, browse or purchase through the KATZ store.

By accessing or using the Services, you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under New Zealand law, including the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

PART 1 — USING THE KATZ STORE

1. ACCESS AND CUSTOMER ACCOUNTS

You may browse our store without creating an account unless a particular feature requires one.

When placing an order or creating an account, you may be required to provide information including your:

  • Name.
  • Email address.
  • Billing information.
  • Payment information.
  • Delivery address.
  • Contact number.

You agree that the information you provide is current, complete and accurate.

If you create an account, you are responsible for:

  • Keeping your login credentials secure.
  • Activity occurring through your account.
  • Updating your details when necessary.

You must not transfer, sell or assign your account to another person without our consent.

You must use the Services lawfully and must not impersonate another person or provide deliberately false or misleading information.

2. ACCEPTABLE USE

You may use the KATZ website and Services for lawful personal or commercial purchasing purposes.

You must not use the Services to:

  • Commit or facilitate unlawful or fraudulent activity.
  • Violate applicable laws or regulations.
  • Infringe our intellectual property rights or the rights of another person.
  • Upload malicious code, viruses or other harmful material.
  • Interfere with the security or operation of the website.
  • Attempt to gain unauthorised access to another account or system.
  • Harass, threaten, abuse or defame another person.
  • Submit false, misleading or fraudulent information.
  • Collect personal information about others without lawful authority.
  • Send spam, phishing messages or other unauthorised communications.
  • Circumvent security measures, access controls or technical restrictions.
  • Scrape or extract website content where such access has been expressly prohibited.

We may suspend or restrict access where we reasonably believe these Terms have been breached.

3. AI AGENTS AND AUTOMATED ACCESS

Automated agents, AI tools, bots and other software that act autonomously or semi-autonomously on behalf of users may interact with the KATZ Services only where that interaction is permitted by KATZ, Shopify and applicable platform rules.

An automated agent must not:

  • Falsely represent itself as a human user.
  • Conceal or deliberately obscure its automated nature where identification is required.
  • Circumvent CAPTCHA, authentication, security or rate-limiting measures.
  • Bypass restrictions intended to control automated access.
  • Access areas of the Services that it is not authorised to use.

KATZ may limit, block or otherwise control automated access where reasonably necessary to protect the Services, customers or business operations.

Nothing in this section is intended to prevent legitimate AI-assisted shopping, discovery or commerce functionality made available or authorised through Shopify or KATZ.

PART 2 — PRODUCTS AND PURCHASES

4. OUR PRODUCTS

KATZ creates and supplies apparel, tumblers, bags, printed products, gifts, merchandise and other creative products.

We make reasonable efforts to ensure product photographs, descriptions, specifications and other information accurately represent the products offered for sale.

However, the appearance of colours may vary slightly depending on:

  • The screen or device being used.
  • Display settings.
  • Lighting.
  • Material type.
  • Production method.

Printed and sublimated products may also exhibit minor production variations, including small differences in:

  • Colour.
  • Print placement.
  • Alignment.
  • Material texture.
  • Garment construction.
  • Product dimensions.
  • Finishing.

Reasonable production variation does not remove any rights you have where a product is genuinely faulty, materially different from its description, or otherwise fails to meet applicable consumer guarantees.

We may modify or discontinue products from time to time.

5. ORDERS

When you submit an order, you are offering to purchase the selected products.

An order is not necessarily accepted merely because payment details have been submitted.

KATZ may decline or cancel an order before fulfilment where reasonably necessary, including where:

  • A product is unavailable.
  • An obvious pricing or listing error has occurred.
  • Payment cannot be authorised.
  • Fraud or misuse is reasonably suspected.
  • Customer-supplied content cannot legally or reasonably be reproduced.
  • We are unable to fulfil the order as described.

Where we decline or cancel an order after receiving payment, we will refund the applicable amount unless another solution has been agreed with you.

We may contact you using the email address, telephone number or other contact details provided with the order where clarification is required.

6. CUSTOM AND PERSONALISED PRODUCTS

Some KATZ products may be customised using:

  • Names.
  • Dates.
  • Photographs.
  • Customer artwork.
  • Business logos.
  • Personal messages.
  • Bespoke designs.
  • Other customer-selected content.

You are responsible for checking that the information you provide is correct before production begins.

This includes checking:

  • Spelling.
  • Names.
  • Dates.
  • Artwork.
  • Images.
  • Colours where specified.
  • Product size.
  • Garment size.
  • Design placement.
  • Other custom details.

Where KATZ supplies a digital proof or artwork approval, you are responsible for reviewing it carefully.

Once a proof has been approved, production may begin.

Changes requested after production has started may not be possible.

If a post-approval change can be accommodated, additional costs may apply where those costs are disclosed and agreed before further work is undertaken.

7. CUSTOMER-SUPPLIED ARTWORK AND CONTENT

When you provide photographs, logos, graphics, wording, trademarks, artwork or other material to KATZ, you confirm that:

  • You own the material; or
  • You have permission or another lawful right to use and reproduce it.

You authorise KATZ to use and reproduce that material only to the extent reasonably necessary to:

  • Prepare artwork.
  • Produce proofs.
  • Manufacture the requested products.
  • Fulfil your order.

You remain responsible for ensuring customer-supplied content does not infringe the intellectual property, privacy or other legal rights of another person.

KATZ may refuse to reproduce material where we reasonably believe doing so could be unlawful or infringe another person's rights.

8. PRICES

Unless otherwise stated, prices displayed on the KATZ New Zealand store are in New Zealand dollars (NZD).

Shipping costs are additional to the product price unless expressly stated otherwise.

Applicable shipping charges will be displayed or otherwise communicated before the purchase is completed.

Where GST applies, it will be dealt with in accordance with New Zealand tax requirements.

Prices, promotions and discounts may change from time to time.

The applicable product price will generally be the price displayed when the order is placed, subject to correction of obvious errors.

If an obvious pricing error occurs, we may contact you before fulfilling the order and provide the option to proceed at the correct price or cancel the affected item.

KATZ will not intentionally use hidden charges, misleading prices or deceptive promotional conditions.

9. PAYMENT AND BILLING

Payment must be made using a payment option offered through the KATZ store.

You agree to provide accurate and complete billing and payment information.

By submitting payment details, you confirm that you are authorised to use the selected payment method.

Payment processing may be provided by Shopify or another authorised third-party payment provider.

Banks, card issuers and payment providers may have their own processing times and terms.

10. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may be subject to specific conditions.

Unless otherwise stated:

  • Discounts cannot be exchanged for cash.
  • Promotions may have expiry dates.
  • Some products may be excluded.
  • Multiple discount codes may not be combinable.
  • Promotional offers remain subject to product availability.

Where specific promotional conditions conflict with these general Terms, the specific promotional conditions will apply to that promotion.

Material promotional conditions will be disclosed clearly.

11. PRODUCT AVAILABILITY

Products may be available in limited quantities.

Adding a product to your shopping cart does not necessarily reserve it.

We may introduce, change or discontinue products at any time.

If an item becomes unavailable after payment, we will contact you and provide an appropriate refund or another solution agreed with you.

PART 3 — SHIPPING, RETURNS AND CANCELLATIONS

12. SHIPPING AND DELIVERY

KATZ currently serves customers in New Zealand unless otherwise stated.

Shipping charges are additional to product prices unless a promotion or product listing specifically says otherwise.

Available delivery options and applicable costs will be displayed during checkout where possible.

You are responsible for providing a complete and accurate delivery address.

Delivery timeframes are estimates unless expressly stated to be guaranteed.

KATZ will take reasonable steps to fulfil and deliver orders within the timeframe communicated or, where no timeframe has been agreed, within a reasonable time.

If an order is lost, damaged during delivery or significantly delayed, please contact us so we can investigate.

Nothing in these Terms removes any responsibilities KATZ has under applicable New Zealand consumer law regarding delivery.

13. RETURNS AND REFUNDS

Our separate Returns & Cancellation Policy forms part of these Terms.

For eligible standard products, KATZ currently offers a voluntary 14-day change-of-mind return period from the date of delivery, subject to the conditions in that policy.

Change-of-mind returns are separate from situations involving faulty, damaged or incorrectly supplied goods.

For approved change-of-mind returns:

  • The customer is responsible for return shipping costs.
  • KATZ does not currently charge a restocking fee.
  • Original shipping costs are generally not refundable unless required by law.

Personalised or custom-made products may not be eligible for change-of-mind returns.

Nothing in this section limits statutory rights where goods fail to meet applicable consumer guarantees.

14. FAULTY, DAMAGED OR INCORRECT GOODS

If a product is faulty, damaged, incorrectly supplied, materially different from its description or otherwise fails to meet applicable consumer guarantees, please contact KATZ promptly.

KATZ may inspect or request reasonable information about the issue before determining an appropriate remedy.

Depending on the circumstances and applicable law, remedies may include:

  • Repair.
  • Replacement.
  • Refund.
  • Another appropriate resolution.

KATZ will comply with obligations imposed by the Consumer Guarantees Act and other applicable New Zealand law.

15. CANCELLATIONS

KATZ currently provides a 1-hour cancellation window through the applicable Shopify process where an order has not already been fulfilled or entered production.

Because some products may be prepared or produced soon after an order is received, cancellation after this period cannot be guaranteed.

Where production has not started, KATZ may choose to approve a later cancellation.

Personalised or custom-made products that have entered production may no longer be able to be cancelled.

Further details are contained in our Returns & Cancellation Policy.

PART 4 — INTELLECTUAL PROPERTY AND CONTENT

16. KATZ INTELLECTUAL PROPERTY

Unless otherwise stated, the KATZ website and its original content, including:

  • KATZ branding.
  • Logos.
  • Original designs.
  • Graphics.
  • Photography.
  • Video.
  • Website copy.
  • Product descriptions.
  • Marketing materials.
  • Layouts.
  • Creative concepts.

are owned by KATZ or used by KATZ with permission from the applicable rights holder.

You may not reproduce, distribute, modify, commercially exploit or represent KATZ intellectual property as your own without permission.

Nothing in these Terms transfers ownership of customer-supplied intellectual property to KATZ.

17. THIRD-PARTY TRADEMARKS AND CONTENT

Names, logos, designs, slogans and other intellectual property belonging to third parties remain the property of their respective owners.

Unless expressly stated, the appearance of a third-party brand, team, organisation, cultural reference or other identifying element does not necessarily mean that KATZ is sponsored by, affiliated with or endorsed by that party.

KATZ reserves the right to remove, refuse or discontinue material where intellectual property concerns arise.

18. CUSTOMER FEEDBACK AND REVIEWS

If you submit a review, testimonial, suggestion, comment or other feedback to KATZ, you grant KATZ permission to use that feedback for legitimate business and marketing purposes.

This may include reproducing or displaying feedback through:

  • Our website.
  • Social media.
  • Marketing material.
  • Advertising.
  • Internal product development.

KATZ will not intentionally alter customer feedback in a manner that materially misrepresents what was originally communicated.

You confirm that feedback you submit:

  • Is accurate to the best of your knowledge.
  • Does not infringe another person's rights.
  • Is not unlawful or malicious.
  • Does not contain harmful software or deceptive content.

Where KATZ wishes to use identifiable customer photographs or similar personal content in marketing, appropriate permission should be obtained.

PART 5 — SHOPIFY, THIRD PARTIES AND PRIVACY

19. RELATIONSHIP WITH SHOPIFY

KATZ Apparel & Print is powered by Shopify, which enables us to provide the Services to you.

However, purchases made from the KATZ store are transactions directly between you and KATZ Apparel & Print.

Shopify is not the seller of KATZ products.

To the extent permitted by applicable law, Shopify is not responsible for the products sold by KATZ or for the performance of the contract of sale between you and KATZ.

Your use of Shopify-powered functionality may also be subject to Shopify's applicable terms and privacy practices.

20. OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The KATZ store may provide access to tools, integrations or services supplied by third parties.

These may include:

  • Shopify applications.
  • Payment providers.
  • Courier providers.
  • Analytics tools.
  • Marketing platforms.
  • Social media services.
  • AI-powered tools.
  • Customer-support tools.

Those third parties may operate under their own terms and privacy policies.

KATZ is not responsible for the independent operation of third-party services outside our reasonable control, although this does not remove any responsibility KATZ has for services used to fulfil our obligations to customers.

21. THIRD-PARTY LINKS

The KATZ website may contain links to websites or services operated by third parties.

KATZ does not control those external websites.

If you choose to access a third-party website, you should review its own terms, policies and practices.

Complaints or concerns regarding products or services purchased directly from an independent third party should generally be directed to that third party.

22. PRIVACY

Personal information collected through the KATZ store is handled in accordance with our Privacy Policy and applicable New Zealand privacy law.

Because the Services are hosted by Shopify, Shopify may process personal information as necessary to operate, support and improve the ecommerce platform.

Other authorised service providers may also process information where reasonably necessary to provide:

  • Payment processing.
  • Delivery.
  • Analytics.
  • Customer communication.
  • Marketing functionality.
  • Other store services.

Please refer to the KATZ Privacy Policy for further information.

PART 6 — WEBSITE AND PLATFORM OPERATION

23. ERRORS, INACCURACIES AND OMISSIONS

From time to time, information on the KATZ website may contain:

  • Typographical errors.
  • Incorrect product information.
  • Pricing errors.
  • Availability errors.
  • Promotion errors.
  • Shipping information errors.
  • Other inaccuracies or omissions.

KATZ may correct inaccurate information when identified.

Where an error materially affects an existing order, we will contact the customer where reasonably appropriate and comply with applicable New Zealand law.

24. WEBSITE AVAILABILITY

We aim to keep the KATZ website available and functioning properly.

However, temporary outages, maintenance, technical faults or third-party service interruptions may occur.

We do not guarantee uninterrupted website availability.

Nothing in this section limits any liability or customer right that cannot lawfully be excluded.

PART 7 — CONSUMER AND LEGAL TERMS

25. NEW ZEALAND CONSUMER GUARANTEES

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under New Zealand consumer law.

Where the Consumer Guarantees Act 1993 applies, products supplied by KATZ must satisfy the guarantees required by that Act.

These may include requirements relating to:

  • Acceptable quality.
  • Fitness for purpose.
  • Matching descriptions.
  • Matching applicable samples or demonstrations.
  • Safety.
  • Durability.
  • Delivery within an agreed or reasonable time.

Where applicable guarantees are not met, customers may be entitled to remedies provided under New Zealand law.

26. FAIR TRADING

KATZ will not intentionally engage in misleading or deceptive conduct or make false or misleading representations about our:

  • Products.
  • Pricing.
  • Quality.
  • Features.
  • Availability.
  • Promotions.
  • Delivery.
  • Business.

Important product conditions, charges or limitations should be communicated clearly rather than hidden in fine print.

27. WARRANTIES AND DISCLAIMERS

KATZ does not exclude or disclaim any statutory guarantee, warranty or consumer right that cannot lawfully be excluded under New Zealand law.

To the extent permitted by law, information provided through the website is supplied for general ecommerce and product-information purposes.

We do not guarantee that every website feature will always operate continuously or without technical error.

Any disclaimer contained in these Terms applies only to the extent permitted under applicable New Zealand law.

28. LIMITATION OF LIABILITY

Nothing in these Terms limits or excludes KATZ's liability where doing so would be unlawful.

Where the Consumer Guarantees Act, Fair Trading Act or another mandatory law applies, those protections take precedence over any inconsistent provision in these Terms.

To the extent permitted by law, KATZ will not be responsible for indirect or consequential losses arising solely from circumstances beyond our reasonable control where KATZ has otherwise complied with its legal and contractual obligations.

29. INDEMNITY FOR CUSTOMER MISUSE AND CONTENT

To the extent permitted by law, you are responsible for losses, claims or costs arising directly from:

  • Your unlawful use of the Services.
  • Your material breach of these Terms.
  • Customer-supplied content that infringes another person's intellectual property or other legal rights.
  • Fraudulent or malicious activity conducted through your account.

This provision does not make you responsible for losses caused by KATZ's own unlawful conduct or failure to meet obligations that cannot lawfully be excluded.

30. BUSINESS AND COMMERCIAL PURCHASES

KATZ also supplies businesses, organisations, teams and events.

Separate quotations, project specifications, credit terms or commercial agreements may apply to:

  • Bulk orders.
  • Uniforms.
  • Staff apparel.
  • Event merchandise.
  • Promotional merchandise.
  • Corporate gifts.
  • Branded product ranges.
  • Other bespoke commercial work.

Where separate written commercial terms have been agreed, those terms will apply to the relevant commercial order to the extent of any inconsistency with these general online-store Terms.

Where permitted by New Zealand law, KATZ and a business customer may expressly agree in writing that particular statutory protections do not apply to a business transaction.

Any such agreement must meet applicable legal requirements.

PART 8 — CONTRACT ADMINISTRATION

31. TERMINATION AND SUSPENSION

KATZ may suspend or terminate access to the Services where reasonably necessary, including where a user:

  • Materially breaches these Terms.
  • Uses the Services unlawfully.
  • Engages in fraud.
  • Attempts to compromise website security.
  • Misuses another person's account.
  • Repeatedly interferes with store operations.

Termination does not remove payment obligations or other rights that accrued before termination.

Provisions that by their nature should continue after termination will remain effective.

32. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or severed to the minimum extent necessary.

The remaining provisions will continue in effect.

33. WAIVER

If KATZ does not immediately enforce a right under these Terms, that does not mean the right has been waived.

A waiver must be clear and applies only to the specific circumstances for which it is given.

34. ENTIRE AGREEMENT

These Terms, together with the policies and any specific terms expressly incorporated into them, constitute the agreement governing use of the KATZ online Services.

For individual purchases, the relevant product listing, order confirmation and applicable policies also form part of the agreement.

For commercial or bespoke work, separately agreed written terms may apply.

35. ASSIGNMENT

You may not transfer your contractual rights or obligations under these Terms to another person without KATZ's consent where doing so would materially affect KATZ.

KATZ may assign or transfer its rights and obligations as part of a legitimate restructuring, sale or transfer of the business, subject to applicable law and without reducing customers' existing statutory rights.

36. CHANGES TO THESE TERMS

KATZ may update these Terms from time to time to reflect changes to:

  • Our business.
  • Products.
  • Services.
  • Shopify functionality.
  • Technology.
  • Policies.
  • Applicable law.

The latest version will be published on the KATZ website.

Where a change materially affects existing customers and notice is required by law, we will provide appropriate notice.

Changes will not retrospectively remove rights that have already arisen under an existing purchase.

37. GOVERNING LAW

These Terms are governed by the laws of New Zealand.

Any dispute will be dealt with in accordance with applicable New Zealand law and any rights customers may have to use the Disputes Tribunal, courts or other available dispute-resolution processes.

38. HEADINGS

Headings are included for convenience and do not alter the meaning of these Terms.
